Minimum Energy Efficiency Standards (MEES)

From April 2018 it has been unlawful to let a building that did not achieve an EPC rating of "E" or higher.

Who is affected

MEES rules apply  to both domestic and non-domestic property for let and is: 

  • the building is located in England or Wales

  • requires an EPC under current rules

  • was subject to a new letting agreement from April 2018

  • is subject to an existing letting agreement from April 2023

Exemptions:

  • long term tenancy agreements lasting 99 years or more

  • short term tenancy agreements under 6 months

  • if the works to be undertaken would result in a devaluation of the property by more than 5%

  • if consent to undertake the works is refused by a tenant or a the local authority
